「軍事審判法部分條文修正案」日前立法院已三讀通過，承平時期軍人犯罪不必送軍事審判，改為一般司法體系偵辦。洪家家屬質疑總統府未依法公告，總統府副發言人馬瑋國12日表示，下午已收到立法院咨文，目前正在處理行政程序，必須等總統馬英九返台後才能公布，公布生效後，將分兩階段執行。
據報導，洪仲丘冤死一案促成軍事審判法部分條文修正案，日前立法院已三讀通過，承平時期軍人犯下凌虐部屬、阻撓部屬陳情、殺人、性侵、竊盜等罪，回歸一般司法程序審理。洪家家屬質疑三讀通過後，總統未依程序公告。
對此，立法院長王金平對此回應，法院在12日下午將陳情書交給總統府，等待總統公布新法。總統府副發言人馬瑋國今天說，對此表示，目前已收到新法文件，目前正依行政程序處理中，將依憲法規章召告公開。
